Acknowledgment Letter — Homeowners (California)
Use this outline to prepare a claim acknowledgment, then verify the applicable requirements. It is drafting guidance, not a completed letter or a guarantee of compliance.
Required Actions and Content Checks
Under 10 CCR §2695.5(e)(1)–(3), act immediately, no later than 15 calendar days after notice of claim, subject to the exception for a notice of legal action:
- Acknowledge receipt, unless payment is made within that period. If acknowledgment is not written, make a dated notation in the claim file.
- Provide necessary forms, instructions, and reasonable assistance, including the information needed for proof of claim.
- Begin any necessary investigation. Do not represent the general 40-day decision period as a deadline measured from claim notice or as a universal investigation-completion deadline.
Separate Declared-Emergency Residential Notice
For a residential property claim arising from a declared state of emergency or another emergency declared by a public official, Insurance Code §14046(b) separately requires delivery of the most recent CDI notice of significant property-insurance laws within 15 calendar days after the insurer receives claim notice. Verify and provide that notice; an acknowledgment or a general complaint-process reference does not substitute for it. Do not assume the acknowledgment's payment exception removes this separate duty.
Helpful Drafting Fields
These fields help identify the claim and explain the process; this list does not label every field as mandatory acknowledgment content:
- Claim and policy identification: Claim number, policy number, named insured, reported loss date, and property address.
- Coverage context: Potentially applicable coverages, without prematurely accepting or denying coverage.
- Assigned adjuster: Name and contact information.
- Next steps: Specific documents needed, forms and assistance provided, and planned investigation steps.
- Next communication: A realistic expected contact date, with the applicable legal trigger checked separately.
- Consumer resources: Appropriate CDI contact information and any independently required notices.
For wildfire smoke claims, consult the California smoke-damage guidance for current investigation duties, 2027 applicability, and separate inspection, testing, ALE, and payment requirements. The CDI 2026 disaster-adjusting guide also explains the existing acknowledgment and disaster-notice duties.
Tone Guidance
The letter should be professional, empathetic, and clear. Avoid jargon. Use plain English to explain what happens next in the claims process.
